GIVEAWAY TERMS & CONDITIONS

1. These terms and conditions (“Terms and Conditions”) shall apply to the 2022 “Buy NBA 2K23 (“Game”) & Win a Nike Gift Card worth $300SGD
(₱12,000PHP)” (“Giveaway”) organised by Epicsoft Asia (Pte) Ltd (“Epicsoft”).

2. By registering or taking part in this Giveaway, you agree to be bound by these Giveaway Terms and Conditions and the decisions of Epicsoft in relation to and in connection with this Giveaway.

Qualifying Period
3. First Giveaway is from 9 August 2022 to 8 September 2022 (both dates inclusive) (“1st Giveaway Period”)

4. Second Giveaway is from 9 September 2022 to 23 September 2022 (both dates inclusive) (“2nd Lucky Draw Period”)

​

5. Epicsoft reserves the right to change the 1st and 2nd Giveaway Periods. 

 

Eligibility
6. This Giveaway is only valid at Epicsoft recognized official retail outlets located locally in Singapore and The Philippines. (“Asia Regions”) Entrants under the age of thirteen (13) years old must seek parental and/or guardian consent before participating in the Giveaway. (“Participant(s)”)

7. The following categories of people are not eligible to participate in the Giveaway:
i) All permanent and/or contract employees (“Employees”) of Epicsoft Group of Companies and their immediate family members (i.e. spouses, children, parents, siblings) (“Immediate Family Members”)

ii) All dealers and/or distributors of the Game and their Employees and Immediate Family Members.

8. Epicsoft has the absolute discretion to determine the eligibility of Participants. Such determination shall be final and conclusive and Epicsoft is not obliged to give any reason for its determination.

Allocation of Giveaway Participation Forms
9. Participants will be given one (1) Giveaway Participation Form with every purchase of NBA 2K23 Standard Edition regardless of Platform from selected Epicsoft-recognised authorized retailers located in the Asia Region. Participants will be given two (2) Giveaway Participation Forms with every purchase of NBA 2K23 Limited Edition regardless of Platform from selected Epicsoft-recognised authorized retailers located in the Asia Region.

10. Only original Giveaway Forms are valid for participation in the Giveaway. Participants must complete their entry at the Giveaway website (https://epicsoft.asia/nba2k23ga) with the full name, contact number, email address, retail brand and retail store where the game was purchased and coupon serial number.

​

11. Epicsoft has absolute discretion to disqualify any Giveaway Participation form that does not meet the criteria set out in these Terms and Conditions. Such determination is final and conclusive and Epicsoft is not obliged to give any reason for its determination.

Prize
12. Subject always to these Terms and Conditions, to be eligible to participate in the Giveaway, every Giveaway Participation form must:
i) be submitted together with a valid game sales receipt from one of the selected approve retail partners of Epicsoft.
ii) contain valid information that matches the Game purchase details in the accompanying receipt
iii) contain customer’s full name, contact information and email address
iv) show proof of purchase of the fully paid and installed NBA 2K23

v) be submitted to Epicsoft office located at ​29 Tai Seng Avenue, #02-01, Natural Cool Lifestyle Hub, Singapore 534119 (“Epicsoft Office”) within 5 days after the 1st and 2nd Giveaway Periods.

13. Epicsoft reserves the right to, at any time and in its sole and absolute discretion, replace and/or substitute any of the Prize(s) with any other item of a similar value.

​

14. There will be twelve (12) Giveaway winners in total. Three (3) each from Singapore and The Philippines for the 1st Giveaway Period. Three (3) each from Singapore and The Philippines for the 2nd Giveaway Period.

​

15. The winners of the 1st and 2nd Giveaway Periods (“Winners”) will be drawn at random at 1200 hours on 20th September 2022 and on 7th October 2022 (“Draw Dates”) respectively at Epicsoft Office.

​

16. All Winners shall be notified by phone at their phone number and electronic mail at their email address as indicated in the Giveaway Participation form within seven (7) calendar days of the Draw Dates.

​

17. Prizes that are not redeemed within fifteen (15) calendar days from the Draw Dates will be forfeited. No correspondence of claims will be entertained in the event of such forfeiture. A Participant whose prize has been forfeited shall not be entitles to any payment or compensation whatsoever from Epicsoft.

18. Reserve winner(s) will be drawn to replace any winner(s) subsequently disqualified.

​

19. Prizes are not transferable, or exchangeable for cash, credits or any other item or otherwise, either partially or wholly.

Use of Personal Information

20. By participating in the Giveaway, the Participants (including the Winners) are deemed to have consented to:
The collection, use and disclosure of his/her name, contact and purchase information by the Epicsoft Group of Companies and/or its affiliates and participating retail partners for editorial, advertising, promotional, marketing and/or other purposes without any payment and/or compensation except where prohibited by law; and receiving promotional, marketing and other publicity information from Epicsoft from time to time.

General
21. The decisions of Epicsoft on all matters relating to or in connection with the Giveaway are final, conclusive and binding. Epicsoft shall not be obliged to give any reason or enter any correspondence with any person on any matter concerning the Giveaway.

​

22. Epicsoft reserves the right at any time in its sole and absolute discretion to determine and/or amend or vary these terms and conditions without prior notice, including but not limited to cancelling, extend, terminating or suspending this Giveaway, the eligibility terms and criteria, the selection and number of winners, and the timing of any act to be done, and all Participants shall be bound by these amendments.

23. In the event of any inconsistency between these Terms and Conditions and any advertising, promotional, publicity and other materials relating to or in connection with the Giveaway, these Terms and Conditions shall prevail.

​

24. The Giveaway and these Terms and Conditions shall be governed by the laws of the Republic of Singapore and all Participants (including the Winners) are deemed to have agreed to submit to the exclusive jurisdiction of the Singapore Courts.
